PRACTICE AREAS > APPELLATE

Due to its extensive civil appellate experience, Braden, Hinchcliffe & Hawley's Appellate Department has successfully represented appellants and respondents in a wide variety of practice areas, including insurance coverage, bad faith, construction defect, and personal injury. As lead appellate counsel or as amicus curiae in appellate matters, we faithfully represent the insurance industry, public entities, business and professional trade associations and other business organizations.

The appellate team utilizes its keen analytical skills to effectively present factual and legal issues for appellate review and decision. Typically, we associate with trial counsel either immediately after trial or when the record is lodged in the Court of Appeal.

We undertake a comprehensive evaluation of the evidence and arguments presented at the trial court level, as well as the orders rendered by the trial court. Thereafter, we call upon our thorough knowledge and understanding of the pertinent decisional authority to prepare all necessary briefs, present oral argument, and seek or oppose further review in the California Supreme Court. Our appellate attorneys have established themselves as revered professionals who provide the highest level of service to clients in myriad ways, including:

  • Appellate Briefs
  • Amicus Curaie Briefs
  • Necessary Motion Practice
  • Presentation of Oral Argument in each of the six California Appellate Districts, the California Supreme Court and the Ninth Circuit Court of Appeals

The Appellate Department also has an extensive writ practice. With respect to non-appealable orders, we seek emergency review from the appellate courts through petitions for extraordinary writ. In addition, we consult with clients and trial counsel at the trial court level in strategical decisions designed to effectively preserve issues for appeal.

Braden, Hinchcliffe & Hawley maintains an active continuing education and training program to enhance our appellate attorneys' technical expertise, practical legal skills and sensitivity to the pragmatic needs of our clients.
